1. Introduction

Welcome to fDeck (the "App"), published by Sensorworks ("we", "us"). By downloading or using the App, you agree to these Terms of Use ("Terms") and our Privacy Policy. If you do not agree, stop using the App. Contact details are in section 6.

2. Use of the App

The App is for your personal, non-commercial use only. You must comply with all Applicable Laws, including UK law and the laws of your country of residence. Without limiting the above, you agree not to:

We may change the App or charge for services at any time. We may collect analytics and usage metrics to operate and improve the App, as described in our Privacy Policy. The App does not display third-party advertisements.

3. Disclaimer and liability

The features available in the App depend on your device's sensors and capabilities, and performance may vary.You must not rely on the App as a primary means of navigation or reference while flying or during any other activity where inaccurate information could cause harm.

Use of the App is at your own risk. The App is provided on an "as is" basis. To the maximum extent permitted by law: (a) Sensorworks disclaims all liability whatsoever, whether arising in contract, tort (including negligence) or otherwise in relation to the App; and (b) all implied warranties, terms and conditions relating to the App (whether implied by statute, common law or otherwise), including (without limitation) any warranty, term or condition as to accuracy, completeness, satisfactory quality, performance, fitness for purpose or any special purpose, availability, non-infringement, information accuracy, interoperability, quiet enjoyment and title are, as between Sensorworks and you, hereby excluded. In particular, but without prejudice to the foregoing, we accept no responsibility for any technical failure of the internet and/or the App; or any damage or injury to users or their equipment as a result of or relating to their use of the App. Your statutory rights are not affected.

Sensorworks, or any of its employees, shall not be liable for any death, personal injury, loss or damage whatsoever caused directly or indirectly in connection with use of the App.

If any part of these Terms is held invalid and we become liable for loss or damage that may lawfully be limited, that liability is limited to the greater of: (a) fifty pounds sterling (£50.00); or (b) the amounts paid by you for in-app purchases or subscriptions in the twelve months before the claim arose.

Warning: all information is presented as is and for reference only. You assume total responsibility and risk for use of this application.

4. Payments and subscriptions

fDeck Premium unlocks additional features. Purchases are processed by Apple or Google. We do not receive or store payment card details.

Payments and subscriptions are charged to your app store account at confirmation of purchase.

4.1 Monthly subscriptions

By purchasing a monthly subscription, you agree to an initial and recurring monthly fee at the then-current rate until you cancel. Subscriptions renew automatically unless cancelled before the end of the current billing period.

4.2 Annual subscriptions

By purchasing an annual subscription, you agree to an initial payment for one year of service. The subscription renews automatically each year at the then-current annual rate unless cancelled before the end of the current billing period.

4.3 Lifetime purchase

A one-time lifetime purchase grants ongoing access to fDeck Premium without recurring subscription fees, subject to these Terms and continued availability of the App.

4.4 Cancellation, restore, and refunds

You may cancel a subscription at any time via Manage subscription in the App settings, which links to your app store account. You may also restore previous purchases using Restore purchases in settings.

Monthly and annual subscriptions are non-refundable except where required by applicable law or the policies of Apple or Google.

5. General

We may update the App from time to time. You may need to install updates to continue using it. We do not guarantee that the App will always be updated or remain compatible with your device. We may stop providing the App at any time.

These Terms, together with the Privacy Policy, are the entire agreement between you and Sensorworks regarding the App. We may update these Terms from time to time; the "Last updated" date shows the current version. Continued use of the App after changes means you accept the updated Terms.

These Terms are governed by English law. You agree to the exclusive jurisdiction of the English courts.
